A married couple from Virginia is embroiled in a legal battle over alleged financial misconduct involving their retirement savings. On November 24, 2025, Eric and Nicole Binkerd filed a complaint in the United States District Court for the Eastern District of Virginia against Terry L. McKee Jr., accusing him of misappropriating funds intended for a business transaction.
The Binkerds’ lawsuit details a series of events that began when Eric Binkerd joined RV Warehouse, operated by International Trading Corp. of Virginia, on January 2, 2024. The plaintiffs allege that McKee, the sole owner and director of RV Warehouse, agreed to sell them the business through installments over five years. This agreement included forming a new corporation, RV Ventures Inc., with an initial purchase of 22.49% of its stock for $224,900 using their tax-deferred savings through a ROBS (Rollovers as Business Startups) transaction.
However, the plaintiffs claim that McKee never transferred control or ownership as promised. Instead, they allege he wrongfully transferred $200,000 from RV Ventures’ corporate account to an unknown account without their consent or knowledge. Despite repeated requests for information and documentation related to this transfer and other financial dealings of RV Ventures, McKee allegedly refused to comply.
The complaint outlines several accusations against McKee: breach of fiduciary duty for mishandling their retirement funds; conversion by exercising control over their investments without authorization; fraud for making false representations about the sale; and breach of contract for failing to fulfill his obligations under their agreement.
The Binkerds are seeking damages totaling $187,900 plus lost profits and gains on this amount due to McKee’s actions. They also request punitive damages amounting to $350,000 for what they describe as willful and wanton conduct by McKee. Additionally, they seek compensation for attorney’s fees incurred during this legal process.
Represented by attorney Christopher K. Jones from Sands Anderson PC in Richmond, VA, the plaintiffs have demanded a jury trial on all issues presented in their case against Terry L. McKee Jr., International Trading Corp. of Virginia d/b/a RV Warehouse (Case No: 4:25-CV-157).
