Plaintiff accuses Defendant (tech giant) of Monopolization

Index Exchange Inc. has filed a compelling lawsuit against Google LLC, accusing the tech giant of monopolistic practices that have stifled competition and innovation in the digital advertising industry. The complaint was lodged on November 10, 2025, in the United States District Court for the Eastern District of Virginia. Index Exchange alleges that Google has used its dominance to unfairly control the markets for open-web display ad exchanges and publisher ad servers.

The crux of Index Exchange’s case is that Google leveraged its early monopoly in internet search to establish a dominant position in other markets, particularly those related to digital advertising technology. According to the complaint, Google’s acquisition of DoubleClick in 2008 was a strategic move to gain control over crucial components of the ad tech stack, including publisher ad servers and ad exchanges. This acquisition allowed Google to wield significant power over advertising sales by manipulating sale logic within its publisher ad server to favor offers originating from Google’s own ad exchange, AdX.

Index Exchange claims that Google’s actions have severely limited competition by making it nearly impossible for rival exchanges to compete on a level playing field. For instance, Google’s “First Look” policy gave AdX an initial opportunity over competing exchanges or demand sources to acquire impressions before any other exchange could bid. This practice effectively gave AdX a right of first refusal over all impressions, significantly disadvantaging competitors like Index Exchange.

Furthermore, Index Exchange argues that Google’s refusal to share user data with any exchange other than AdX has created an additional barrier for competitors. By withholding critical user identifiers and data analytics from rival exchanges, Google has ensured that only its tools can offer advertisers enhanced targeting capabilities, thereby increasing their bids and further entrenching Google’s market power.

In response to these challenges, Index Exchange has sought relief through legal action. The company is requesting that the court find Google guilty of monopolization under Section 2 of the Sherman Act and is seeking damages as well as injunctive relief to prevent further anticompetitive conduct by Google.

Representing Index Exchange are attorneys from prominent law firms specializing in antitrust litigation. The case is being presided over by judges from the Eastern District of Virginia under Case ID 1:25-cv-02003.
