Northrop Grumman Systems Corporation has taken legal action against a technical services company, accusing it of gross negligence that led to the destruction of critical satellite equipment. The complaint was filed by Northrop Grumman in the United States District Court for the Eastern District of Virginia on February 4, 2026, targeting NTS Technical Systems, LLC, which operates under the name Element U.S. Space & Defense.
The case revolves around a contract between Northrop Grumman and Element for vibration testing services on solar arrays intended for a satellite program. According to Northrop Grumman, Element failed to uphold its end of the agreement when an unqualified technician connected a cable incorrectly during pre-testing procedures on October 22, 2024. This mistake resulted in an uncontrolled electrical impulse that destroyed Northrop Grumman’s Engineering Qualification Model (EQM) wing assembly valued at $5 million. The incident was reportedly captured on video at Element’s facility.
Northrop Grumman alleges that Element breached their contract by not providing competent personnel or adhering to rigorous risk reduction protocols as promised. Furthermore, Northrop Grumman claims that Element did not secure the necessary insurance coverage to protect against such damages and failed to add Northrop Grumman as an additional insured party. Despite repeated attempts by Northrop Grumman to resolve the issue amicably and recoup over $10 million in damages—including costs related to replacing the EQM and delays in their project schedule—Element has allegedly refused to compensate them.
In response to these grievances, Northrop Grumman is seeking a court judgment against Element for breach of contract and bailment violations. They are requesting compensation exceeding $10 million for various incurred costs and damages, including attorney fees and interest. The plaintiff is represented by Anthony M. Conti from Conti Fenn PLLC.
The case is under Case No. 1:26-cv-337.
