Eric Hall, a military veteran from Virginia, has filed a lawsuit against PHH Mortgage Corporation in the United States District Court for the Eastern District of Virginia. The case centers around PHH’s alleged mishandling of Hall’s application for the assumption of a Department of Veterans Affairs (VA) guaranteed home loan. Hall claims that PHH failed to process his application within the mandated timeframe and misrepresented that the necessary documents had been submitted to the VA when they had not. This delay purportedly caused Hall financial and emotional distress as he was forced to pay both mortgage and rent due to the delay in finalizing his home sale. The complaint includes allegations of constructive fraud, violation of RESPA regulations, breach of contract, and negligent hiring and supervision by PHH. Hall is seeking compensatory and punitive damages amounting to no less than $75,000.
