RICHMOND, Va. — Attorney General Jason Miyares has aligned with 27 other attorneys general to urge the National Collegiate Athletic Association (NCAA) to restore records and honors of female athletes impacted by policies allowing biological males to compete in female sports categories.
Title IX is a federal law that prohibits sex-based discrimination, ensuring equal access to educational programs and athletics based on biological sex. The Biden administration’s attempt to redefine “sex” to include “gender identity” has led to significant debate over its implications for education and athletics.
In April 2024, Virginia joined five other states in a lawsuit challenging this reinterpretation of Title IX. By January 2025, this effort resulted in a nationwide vacatur preventing the enforcement of the policy across the country. Without this legal action, schools would have had to allow biological males identifying as female access to girls’ facilities and programs from preschool through college.
Attorney General Miyares collaborated with attorneys general from Alabama, Alaska, Arkansas, Florida, Georgia, Guam, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio Oklahoma South Carolina South Dakota Tennessee Texas Utah West Virginia Wyoming in addressing their concerns to the NCAA.
